Terms and Conditions of Sale

Version 2.1 - 1 February 2022

These Terms apply to any orders you place through Spaces Joinery Ltd, registered in England and Wales as Company Number 12702913, (as referred to as the ‘Company’ or otherwise referred to as ‘we’, ‘us’, ‘our’) for products (‘Product(s)’) and any contract(‘Contract’) that the Company offers and then makes with you in response to your order. You should retain a copy of these Terms and Conditions for your future reference. We recommend that you read them carefully.

Our Contract

We list all our prices exclusive of VAT. Please note that all our prices are subject to change without notice, so please check prices carefully before placing your order.

If you are purchasing VAT exempt products, the delivery charge (if applicable) will also be exempt from VAT. If you purchase a mixture of standard VAT products and VAT exempt products, your delivery charge will have VAT added to it relative to the value of products in your basket which is VAT inclusive. Placing Your Order

You must agree to accept these Terms in full before your order can be placed.

Please take the time to read and check your order carefully at each stage of the process. Please make sure that you provide your correct phone number and email address when you place your order. When you place your order, this represents an offer to purchase Product(s) from us.

Your order will be detailed on a standard Order Form which, along with any drawings, details exactly what will be produced and the total cost of the order. Once you have signed or emailed to accept the order we may be unable to change the order if production has started, and any changes are likely to incur additional charges.

Prices and Payment

Standard terms of payment are:

  • Cash – 75% payable at the time of placing your confirmed order, with the balance payable on despatch
  • Credit account – available to tradespeople subject to successful application for a credit account (details available onrequest)

You can pay for Product(s) ordered through us by debit/credit card or bank transfer. However, any payment taken does not mean that your order has been accepted and if we reject your order for any reason (see below), or we cannot supply the Product(s) you have ordered, we will issue a full refund of the total amount paid to us.

Accepting an Order

Prior to accepting your order, we reserve the right to reject your order for any reason. In particular, all orders are subject to stock availability. We will tell you as soon as possible if we cannot supply one or more of the Product(s) that you have ordered and aim to offer a suitable alternative where possible.

Unless we reject your order, your order will be automatically accepted when we schedule production of your order, provided that we have received any payment due against the order. The Contract between us is formed at the time we begin production of your Product(s).

Without affecting your Consumer Cancellation Right, you can cancel your order for a Product at no cost, at any time before we dispatch that Product. However, if we’ve already cut or made a Product to your specific measurements, or personalised it for you in any other way, this right to cancel does not apply.

Delivery and Title

Unless you choose to collect the goods from our address as stated on the website and through our various communications, and except in exceptional circumstances, we aim to deliver the goods per your order within the stated delivery time (except in exceptional circumstances). We reserve the right to deliver an order in instalments by separate delivery shipments.

At the point of order, you will be given an estimated delivery lead time. A member of staff will then be in contact before this date to arrange a confirmed delivery time which suits you. Our standard delivery slot is 8am to 6pm during Monday to Friday only, unless otherwise agreed by us in writing. We will endeavour to call approximately one hour before the delivery is due to take place.

We will not be liable for any additional installation or construction that otherwise commences resulting in a financial loss to you as a result of unforeseen delivery delays. We will not provide any waste removal services upon delivery and installation, unless otherwise agreed by us in writing.

Accepting Delivery

We will try to make one single delivery where possible; however, this may not always be possible.Delivery dates will always be scheduled with you prior to taking place, therefore failure to accept delivery on the agreed date mayresult in a redelivery charge of  99+VAT.

All deliveries are required to be signed for by a person over the age of 18. Each item delivered will be detailed and should be checked and confirmed prior to signing the delivery note. We cannot accept any responsibility for items missing or damaged when a confirmation and signature has been obtained. Any shortages or damage must be reported at point of delivery to enable us to replace them. Failure to do so will result in replacements being chargeable.

Ownership and Title

Upon delivery or collection of the goods by you, the goods shall be at your risk and responsibility. Despite delivery or collection,ownership (also known as “title”) of the goods shall not pass to you until you have paid the price for the goods in full and, where other sums payable to us from you are overdue, you have paid those sums too. Until title in the Goods passes from us to you, you shall: (i) return the goods to us immediately if we ask you to; and (ii) be liable to us for any loss, damage or destruction of the goods.

Faulty or Damaged

In the unlikely event that a Product is faulty, not as described or delivered damaged, your rights are set out in our Group Sale Terms.If you’re ordering Product(s) from us as a consumer rather than in the course of your business, you may have additional legal rights and nothing in these Terms or our Group Sales Terms will affect these rights. In the first instance, please contact us if there’s an issue with your order if it arrives faulty or damaged.

If there are any issues with the Product(s) you’ve ordered, please contact us immediately so we can help. Please have your order number as well as details of the affected Product(s). If we offer you a refund, this will be credited to the card or account used to purchase the affected Product(s).

Statutory Rights

If you are ordering Product(s) from us as a consumer, you have a statutory right to cancel any orders (excluding orders for bespoke or made-to-measure Product(s)) and receive a full refund, including standard delivery charges. This is your Right as noted in the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations Act of 2013.

To exercise this right, you must contact us at any time before the Product(s) are dispatched or within 14 days of delivery, starting on the day after your delivery is made. If your order is delivered in multiple shipments, the 14 day period starts the day after the last instalment is delivered.

If we receive your cancellation notice outside these timeframes, this right will not apply. Please also note that if you exercise this right after the Product(s) have been delivered, you’ll be responsible for returning the Product(s) to us at your own cost and within 14 days of cancelling your order.

Returning Faulty Goods

Unless you have a consumer cancellation right or faulty/defective Product any cancellations/returns and refunds are at our discretion. To enquire about cancellations and returns, please contact us with your order number, postcode and phone number. If we do accept a return of the Product(s), they must be returned in their original condition within 30 days of the date of delivery to you.You’ll be responsible for returning the Product(s) to us at your own cost and we may deduct a restocking charge from the amount of your refund.

Additional Information

If any part of these Terms is found to be invalid or unenforceable then, to the extent that it is invalid or unenforceable, the part in question will be treated as if it has been severed from these Terms.

If this happens, the remaining parts of these Terms will continue in full force and effect. We reserve the right to make changes to these Terms in the future without giving notice. Any changes will be posted to this website and will take effect immediately.

Therefore, you should read these Terms each time you access this website and before placing an order with us. These Terms and any Contracts shall be governed by and construed in accordance with English law and shall be subject to the exclusive jurisdiction of the English courts.

If you are not satisfied with your purchase please contact us. We will try to resolve any issues that you have as quickly as possible. If you remain unhappy with our final response, you may access the European Commission's Online Dispute Resolution Portal available at http://ec.europa.eu/consumers/odr/.
